1.1 We sell tickets for "Events"
1.2 The quantity of tickets available for sale varies on an event by event basis. Tickets are generally sold through three distribution points including: on-line, by telephone and in the foyer of the Kingsley Hall on the day of the event. All distribution points access the same ticketing system and inventory, therefore tickets for popular events may sell out quickly. Please be aware we cannot accept credit/debit card payments over the telephone and the foyer at Kingsley Hall only accepts cash.
1.3 For some events, tickets may be sold as part of a "Package" (where a ticket for an event is sold together with concessions, such as refreshments as an inclusive package at an inclusive price).
1.4 In this Purchase Policy, we refer to any products offered for sale by us (such as tickets and Packages) as "Items".
1.5 To purchase Item(s) on-line from us, you must be 18 or over and have a valid credit/debit card issued in your name.
2.1 Any purchase of an Item from us is subject to: (i) this Purchase Policy; (ii) any special terms and conditions which may be displayed on our website.
2.2 Your contract for purchase of an Item starts once we have confirmed your purchase and ends immediately after the completion of the event for which you have purchased the Item. All on-line purchases are subject to payment card verification and other security checks and your transaction may be cancelled if it has not passed our verification process.
2.3 You agree not to obtain, or attempt to obtain, any Items through unauthorised use of any robot, spider or other automated device or any other illegal or unauthorised activity. We reserve the right to cancel any transaction which we reasonably suspect to have been made in breach of these provisions, without any notice, to you and any and all Items purchased as part of such transaction will be void.
2.4 We reserve the right to cancel bookings which we reasonably suspect to have been made fraudulently.
3. Prices and fees
3.1 Whilst we try to ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of any Item you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price (and credit or debit your account as appropriate) or cancelling your order. If we are unable to contact you, you agree that we may treat the order as cancelled. If you choose to cancel after you have already paid the incorrect price, you will receive a full refund from us.
4.1 If you have purchased/reserved any product you are entitled to cancel your transaction within fourteen (14) days of the day of purchase/reservation. Please inform us by telephone and/or email quoting your booking confirmation and/or reservation details. For contact details please see contact us
5.1 When you order tickets online confirmation is automatically generated and sent to you via email – this will act as your proof of purchase/booking confirmation. We do not send tickets by post, so please remember to bring your invoice with you to the event. If you order by telephone, we will reserve your seats for the event in question – please report to the desk in the Kingsley Hall foyer ahead of the event where you can pay for and/or collect instructions in respect of your booking.
6.1 Any ticket you purchase from us remains the property of WHYT and is a personal revocable licence which may be withdrawn and admission refused at any time. If this occurs, you will be refunded the full price of the ticket which has been withdrawn or for which access was refused.
7.1 If an event is cancelled or rescheduled, we will use reasonable endeavours to notify you of the cancellation. We do not guarantee that you will be informed of such cancellation before the date of the event.
7.2 Please note that advertised start times of events are subject to change. If an event start time is changed, we will use reasonable endeavours to notify you of the change. We do not guarantee that you will be informed of such change before the date of the event.
7.3 Tickets are sold subject to WHYT's right to alter or vary the programme due to events or circumstances beyond its reasonable control without being obliged to refund monies or exchange tickets, unless such change is a material alteration as described in paragraph 8.4, in which case the provisions of this paragraph shall apply.
8.1 On the rare occasion, an event is cancelled, rescheduled or materially altered for a variety of reasons. Please contact us for exact instructions.
8.2 Cancellation: If an event is cancelled (and not rescheduled), you will be offered a refund of the sale price of your ticket(s).
8.3 Rescheduling: unless indicted otherwise in relation to a particular event, if an event is rescheduled, you will be offered seats at any rescheduled event (subject to availability). If you are unable to attend the rescheduled event, you will be offered a refund of the sale price of your ticket(s). You must inform us within the time specified by us if you are unable to attend the rescheduled event, otherwise we may reconfirm your booking for the rescheduled date and you will not be entitled to claim a refund.
8.4 Material alteration: If an event is materially altered, you will be offered an option to either reconfirm your order for the altered event or to claim a refund (of the sale price of your ticket(s), within such time as specified by us. Failure to inform us of your decision may result in your order being reconfirmed for the altered event and you will not be entitled to claim a refund. A 'material alteration' is a change which, in our reasonable opinion, makes the event materially different to the event that purchasers of tickets, taken generally, could reasonably expect. The use of understudies in theatre performances and/or any changes of: (i) any supporting act; (ii) members of a band; and/or (iii) the line-up of any multi-performer event (such as a Variety Show) shall not be a material alteration.

8.6 This Purchase Policy does not and shall not affect your statutory rights as a consumer. For further information about your statutory rights, please contact Citizens Advice or the Department for Business Innovation and Skills.
8.7 We regret that, unless paragraphs 8.2, 8.3 or 8.4 apply, tickets cannot be exchanged or refunded after purchase.
9.1 Unless otherwise stated in this clause 9, our liability to you in connection with the event (including, but not limited to, for any cancellation, rescheduling or material change to the programme of the event) and the Item you have purchased shall be limited to the price paid by you for the Item..
9.2 We will not be liable for any loss, injury or damage to any person (including you) or property howsoever caused (including by us): (a) in any circumstances where there is no breach of a legal duty of care owed by us; (b) in circumstances where such loss or damage is not a reasonably foreseeable result of any such breach (save for death or personal injury resulting from our negligence); or (c) to the extent that any increase in any loss or damage results from breach by you of any of the terms of this Purchase Policy or your negligence.
9.3 Nothing in this Purchase Policy seeks to exclude or limit our liability for death or personal injury caused by our negligence, fraud or other type of liability which cannot by law be excluded or limited.
10. Admission and Attendance
10.1 The venue reserves the right to refuse admission should patrons breach any terms and conditions of the event. The venue may on occasions have to conduct security searches to ensure the safety of the patrons.
10.2 Every effort to admit latecomers will be made at a suitable break in the event, but admission cannot always be guaranteed.
10.3 The unauthorised use of photographic and recording equipment is prohibited. Any photos, videos and/or recordings may be destroyed or deleted. Laser pens, mobile phones, dogs (except guide dogs) and a patron's own food and drink may also be prohibited (please check with us first).
10.4 You and other ticket holders consent to filming and sound recording as members of the audience.
10.5 Prolonged exposure to noise may damage your hearing.
10.6 Special effects which may include, without limitation, sound, audio visual, pyrotechnic effects or lighting effects may be featured at an event.
11. Queries and Complaints

11.2 We will endeavour to resolve complaints as quickly as possible.
11.3 If any dispute arises, we shall use our reasonable endeavours to consult or negotiate in good faith, and attempt to reach a just and equitable settlement satisfactory to you and us.
11.4 Although this does not restrict your rights to pursue court proceedings, if we are unable to settle any dispute by negotiation within 28 days, you and we may attempt to settle it by mediation. To initiate mediation, a party must give written notice to the other parties to the dispute requesting mediation. The mediation shall be conducted in accordance with the STAR Code of Practice (see below for contact details) current at the date of the referral which sets out the procedures to be adopted, the process of selection of the mediator and the costs involved, and which terms are deemed incorporated into this agreement.

12.1 All of these terms and conditions are governed by English Law and any disputes arising out of any transaction with WHYT are subject to the exclusive jurisdiction of the English Courts.
You agree that you are only authorised to visit, view and to retain a copy of pages of this Site for your own personal use, and that you shall not duplicate, download, publish, modify or otherwise distribute the material on this Site for any purpose other than to review event and promotional information, for personal use, or to purchase tickets or merchandise for your personal use, unless otherwise specifically authorised by WHYT to do so. You also agree not to deep-link to the site for any purpose, unless specifically authorised by WHYT to do so. The content and software on this Site is the property of WHYT and/or its suppliers and is protected by English and international copyright laws. We post a legal notice and various credits on pages of the Site, which may not be removed. Please do not remove this notice or these credits, or any additional information contained along with the notices and credits.
WHYT does not promise that the Site will be error-free, uninterrupted, nor that it will provide specific results from use of the Site or any Content, search or link on it. The Site and its Content are delivered on an "as-is" and "as-available" basis. WHYT cannot ensure that files you download from the Site will be free of viruses or contamination or destructive features. In particular, users who submit Content to this Site, whether articles, images, stories, software or other copyrightable material must ensure that the Content they upload does not infringe the copyrights or other rights of third parties (such as privacy or public rights). No Commercial Use
No area of this Site may be used by our visitors for any commercial purposes such as to conduct sales of tickets, merchandise or services of any kind. You must obtain our prior written consent to make commercial offers of any kind, whether by advertising, solicitations, links, or any other form of communication. Without limiting the foregoing, you may not use this Site to resell or link to other sites for the purpose of selling tickets of any kind. We will investigate and take appropriate legal action against anyone who breaches this provision, including without limitation, removing the offending communication from the Site and barring anyone breaching this provision from use of the Site. We reserve the right to block access to this Site or WHYT’s other services, or to cancel a ticket order or ticket with respect to any person who is known or reasonably believed to be: a) acting unlawfully, or breaching these Terms, or infringing WHYT's rights, or utilising automated means to process or place ticket orders, or whose ticket order exceeds the stated limit; or b) associated with any person who is known or reasonably believed to be acting unlawfully, or breaching these Terms, or infringing WHYT's rights, or utilising automated means to process or place ticket orders.
Access and Interference
You agree that you will not use any robot, spider, other automatic device, or manual process to monitor or copy our web pages or the content contained thereon or for any other unauthorised purpose without our prior express written permission. You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of the WHYT website. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. You agree that you will not copy, reproduce, alter, modify, create derivative works, or publicly display any content (except for your own personal, non-commercial use) from our website without the prior express written permission of WHYT.
Unauthorised Use of the Site
Illegal and/or unauthorised uses of the Site, including, but not limited to, unauthorised ticket sales, unauthorised framing of or linking to the Site, or unauthorised use of any robot, spider or other automated device on the site, will be investigated and appropriate legal action will be taken, including without limitation civil, criminal and injunctive redress.

Limitation on Liability
Except in jurisdictions where such provisions are restricted, in no event will WHYT be liable to you for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits, even if WHYT has been advised of the possibility of such damages.
This site is controlled and operated by WHYT in the United Kingdom. If there is any dispute about or involving the Site, by using the Site, you agree that the dispute will be governed and construed by English law. In the event of a dispute arising out of or relating to these terms and conditions, or your use of or access to this site, litigation must be brought in court in London, England without regard to its conflict of law provisions.
You agree to indemnify and hold WHYT and its volunteers, harmless from any loss, liability, claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Site, including also your use of the Site to provide a link to another site or to upload content or other information to the Site.
